Dine In Cupertino — Program Terms

Operated by: Viva Global LLC, on the EatLocally platform at eatlocally.ai.
These Dine In Cupertino Program Terms (“Program Terms”) supplement the EatLocally Platform Terms (“Platform Terms”), which apply to all use of the platform. In any conflict between these Program Terms and the Platform Terms, these Program Terms control with respect to your participation in Dine In Cupertino.
By creating an account, claiming a listing, or signing in for the Dine In Cupertino program, you agree to both these Program Terms and the Platform Terms.
1. The Program
Dine In Cupertino is a chamber-curated catering, lunch, and events network connecting Cupertino-area offices with chamber-member restaurants and venues. The Chamber sets program rules; Viva Global operates the EatLocally platform on the Chamber’s behalf.
Cross-chamber discoverability. Dine In Cupertino is one program on the EatLocally platform. Restaurants and companies in other participating chambers can discover and transact with each other when they fall inside a Restaurant’s declared service radius — your single chamber membership covers you platform-wide. You don’t need to join multiple chambers.
Scope. These Program Terms cover your participation in Dine In Cupertino. Other Viva Global products you choose to use (subscription tiers like Pro, or usage/transaction-priced features like payment processing) are governed by your separate agreement with Viva Global LLC at the pricing published at goviva.ai/pricing — not these Program Terms. The Chamber is not a party to those commercial relationships and receives no portion of those fees.
2. Who Qualifies (and What’s Free)
Participation is free under both tiers below. The Chamber and Viva Global take no fees, commissions, or revenue share from your transactions today.

The Chamber may revise these commercial terms with at least 60 days’ notice to active Members.
3. Restaurant Commitments
If you are a Restaurant in Dine In Cupertino:
- Pricing autonomy. You set prices, minimums, lead times, deposits, and cancellation terms. The Platform never quotes on your behalf, and the price you quote is the price you charge.
- Honor accepted orders. You decide which to accept; once you do, fulfill on your stated terms. Declining a request before accepting is fine.
- Respond within 48 business hours. Persistent silence after a claimed listing leads to unclaim and a delisting prompt.
- Service radius covers cross-chamber inquiries. You declare how far you’ll cater; anything inside that radius is a discoverable request, regardless of which chamber the company belongs to.
- Customer data is yours. Orders you’ve fulfilled are yours to keep and to contact going forward, subject to your own privacy obligations.
General acceptable-use rules and the platform-wide quality bar are in the Platform Terms §3 and §4.
4. Company Commitments
If you are a Company in Dine In Cupertino:
- Eligibility. Verified work-email domain plus at least one office address in a participating chamber’s region. Authorized users (HR / office managers on the company’s domain) only.
- Quote = request, not commitment. A request becomes a binding order only when the Restaurant confirms with terms and you accept the quote in-platform.
- Direct payment. You pay the Restaurant on the Restaurant’s terms (invoice, card, ACH). Viva Global is not in the money flow and is not party to the transaction.
- Cancellation. Per the Restaurant’s posted cancellation policy, surfaced on the quote. Default standard is 48 hours before the event unless the Restaurant specifies otherwise.
5. Listings & Claiming
Chamber-member listings. Chamber-member spots are listed automatically with chamber consent. The owner can edit or remove the listing at any time.
Non-chamber Cupertino-area listings. Restaurants in the Cupertino service area may be listed from publicly available information (menu, address, contact info) so they’re discoverable. Each unclaimed listing is clearly marked, includes a one-click opt-out link, and reply STOP to any program email also opts out — opt-outs are honored within 24 hours.
Claiming a listing means you accept these Program Terms and the Platform Terms, including the 48-business-hour response commitment in Section 3.
6. Roles in Plain English
- The Chamber issues this Program and is the data controller for Member data. Curates the chamber-member roster and lends co-brand. Never in the money flow. Never a party to any transaction.
- Viva Global (operator of the EatLocally platform) is a messenger and directory operator and the data processor. Not a caterer. Not a payment processor. Not a guarantor of fulfillment.
- Restaurants and Companies transact directly with each other.
7. Changes to These Program Terms
The Chamber may add, remove, or adjust Program features with at least 30 days’ notice. Changes to the commercial terms in Section 2 (fees, eligibility for free use) require 60 days’ notice.
Material changes to these Program Terms are subject to the Chamber’s approval before publication.
